Masayang ipinabatid sa publiko ng pamunuan ng TV5 at ng TVJ management ang magandang balita na naipanalo na nila ang kaso laban sa kung sino ba talaga ang nagmama-ari ng trademark na Eat Bulaga.
Narito ang kabuuan ng decision na inilabas ng IPOPHL o Intellectual Party Property of the Philippines.
The Intellectual Party Property Office of the Philippines (IPOPHL) has ruled in favor of 'E.A.T.' trio Tito Sotto, Vic Sotto, and Joey de Leon in their trademark cancellation case against Television and Production Exponents (TAPE) Inc. Last August, the IPOPHL granted TAPE's request for renewal of the trademark "Eat Bulaga!" and its logo for 10 years. In its decision dated December 4, the IPOPHL said TVJ "successfully established" that they coined the 'Eat Bulaga' mark. "Having sufficiently established how Petitioners coined the EAT BULAGA mark, it is Petitioners and not Respondent-Registrant who owns the mark. Considering that Petitioners are the owners, they have absolute and exclusive right to register the EAT BULAGA mark and all variations thereto..." the decision read. According to the IPOPHL, a trademark is a word, a group of words, sign, symbol, logo, or a combination thereof that identifies and differentiates a business from others
